| 摘 要： | 法律思维对于法律文化的形成起着中介的作用,其思维倾向对于文化特色的蕴育有着定向的功能。中国法律文化独树一帜,其思维倾向可以概括为阴阳思维、尚德思维和无讼思维。法祖思维、清官思维可归为尚德思维的基本内容中。

| Abstract: | Legal thinking is a medium in the formation of legal culture,whose thinking tendency plays an orientational function in the fostering of cultural features.Chinese legal culture is unique because its thinking tendency can be generalized as Yin and Yang thinking,the thinking that treasures morality and the thinking that devalues lawsuit.Fazu thinking and the thinking that treasures honest and upright officials are covered in the basic contents of the thinking that treasures morality. |
