论先行行为引起的不作为犯与结果加重犯的关系

先行行为能否产生作为义务,关键看是否存在作为义务。任何人都要遵守刑法规范设定的义务,一旦破坏规范,只有承担刑事责任,而无义务再防止危害后果的发生。结果加重犯中的重结果是在主观意志之下的产物,法律意义上的不作为也是主观意志之下的不作为,以不作为的主观方面与结果加重犯的主观方面是否对应来判断成立结果加重犯,还是成立不作为犯。
