从国际法视角看联合国与非政府组织的制度化联系

历史地看,非政府组织从登上国际舞台至今,始终在为谋得恰当的国际法律地位而努力。联合国成立后,根据宪章第71条确立起来的经社理事会与非政府组织咨商关系,逐渐成为非政府组织间接取得一定的国际法地位的主要途径。本文拟从国际法视角对经社理事会与非政府的组织制度化联系模式进行探讨,并对进一步完善非政府组织在国际法律秩序中的地位问题进行思考。

The Institutional Relationship between UN and NGO:A Perspective of International Law

International Non-governmental organizations are playing an increasing role on the international scene, and their position in relation to international law is generally regarded as important but informal. The aim of this study is to provide the legal context of Consultative Relationship between non-governmental organizations and the United Nations, investigate the present legal status of international non-governmental organizations under the UN legal system, and to discuss this status in relation to the function and legitimacy of the international legal system.
