从法确定性的问题生成语境出发,对理性与法律确定性联盟建立及破裂的演变过程进行了梳理与分析。分析认为：法的确定性问题是理性危机在法律领域的必然逻辑推演;拯救法的确定性,需要在理性反思＂理性＂的基础上,赋予法的确定性以新的时代内涵,应清醒认识中西问题语境的差异,确立对中国法治＂坚守中适度超越＂的应有态度。

Explanation to legal certainty and its uncertainty from the view of context situation

This pape,in view of the controversy about legal certainty,studies the evolution process of the internal relationship between human reason and legal certainty.An in-depth analysis contends that the crisis in the field of law is an inevitable kind of crystallization of the crisis.Therefore,to secure the certainty of law,the endeavors should be made to imbue the legal certainty with new epoch connotations in the light of reflections upon the "human reason",whereas there is a need to enhance the awareness of the cross-cultural differences in context for the legal certainty questioned and to hold on to transcendence of Chinese rule of law in moderate measures.
