地方高校法律诊所发展模式的可行性探讨

法律诊所实践教学模式的引进,极大地丰富了法学的实践教学内容。但是,随着这一教学模式的深入开展,各高校尤其是地方高校,都遇到了师资薄弱、资金短缺、学生实践机会少等问题,寻求新型的法律诊所模式的构建,是突破传统模式的瓶颈所需。新型法律诊所模式主要包括:对诊所进行部门化,扩大学生的参与面;让诊所面对社会,实施"走出去"的战略;设"法律讲堂",把司法引进校园。为了达到这一目的,需要采取的措施包括:建设双师型教师队伍;强化学生法律诊所实践课堂的参与度,实行全程实践教学;扩大资金的来源渠道,以保障法律诊所教学可持续发展。

A study of the Feasibility of Law Clinic Development in Local Universities

Law clinic as a practice teaching mode, has largely enriched the content of practice teaching of law. How- ever, universities especially local ones are confronted with problems like lack of teaching staff, financial resources and practice opportunities for students. Therefore, it is necessary to establish a new mode to sustain the operation of law clinic. The author suggests that efforts be made to extend the range of student participation, to bring law clinic into society and to introduce judicature into university campuses by means of ＂Law Lectures＂. To achieve the above goals we need a team of teachers qualified both in theory and practice of law. It is also necessary to implement an all through practice teaching policy and to seek access to more financial resources.
