| 摘 要： | 非法证据违反了证据的合法性原则,但违反证据合法性的并非都是非法证据,对于这些证据不能以非法证据排除规则简单的予以排除,在检察审查逮捕、审查起诉环节可以采取合法的转化手段予以补救.

| Abstract: | Illegal evidence violates the evidence legitimacy principle,but not all the evidences violating evidence legitimacy principle is illegal.And it should not be excluded pursuant to the evidence rule.It can be transformed through the valid means in the approval of the arrest and examination before prosecution. |
