| 摘 要： | 刑事证明标准模式可分为"客观真实"、"法律真实"和"主观真实"三种模式,每种模式各有其理论依据并各有利弊。将三者有机整合而成的"实在且正当的主观真实说",是我国刑事证明标准模式的合理选择。

| Abstract: | The modes of the standard of criminal proof can be classified into three kinds:"objective truth","legal truth" and "subjective truth".Each mode is based on different theory and has its own advantages and disadvantages. The mode of "subjective truth with the nature of being positive and due" is a theory combined with the advantages of the three theories, which should be the reasonable choice in establishing the mode of the standard of criminal proof in our country. |
