| 摘 要： | 由法律与伦理的一般关系分析入手 ,考察了法律发展与伦理类型的有机联系 ,引申出中国法制现代化与伦理变迁的互动关系 ,得出中国法制现代化的实现依赖于传统宗法伦理向现代契约伦理转型的结论。最后 ,着重从法制现代化的价值目标、运作环境和实施效益三个层面阐明了当代中国法制现代化与建构契约伦理的高度一致

| Abstract: | On the basis of the analysis of the general relationship between law and ethics, and the survey of the organic correlation between law development and ethic types, the essay introduces the interaction between the modernization of the Chinese legal system and the ethic vicissitude. It concludes that the realization of the modernization of the legal system in China depends on the transformation of the traditional patriarchal clan ethical system to the modern contracted ethics. Thereafter, it illustrates the great consistency between the modernization of the Chinese legal system and the construction of the contracted ethics in the light of the three levels of the modernization of the legal system -- its value and target, its operational environment and its practical effect. |
