| 摘 要： | 通过对策分析,认为在代表人诉讼制度中,诉讼代表人极有可能与对方当事人串通损害被代表人的利益,所以,完善代表人诉讼制度中的监督机制,维护被代表人更换诉讼代表人的权利,引进损害赔偿责任极为必要。

| Abstract: | Through game theory analysis ,this paper draws a conclusion that in representative's lawsuit system, law representative will probably gang up with the other side party to damage the interests of representative's principal .So it's extremely essential to perfect the supervision mechanism in representative's lawsuit system ,maintain the principal's rights by changing the lawsuit representative, and introduce compensation system for damage . |
