论国际航空运输“不轨旅客”侵权的法律适用

相较一般侵权而言,发生在国际航空运输中的“不轨旅客”侵权具有特殊之处,其特殊性直接影响着法律适用方法的选择与应用。目前,关于处理国际航空侵权的法律适用问题仍缺乏统一的法律适用规则。建议对国际航空运输中的“不轨旅客“侵权的法律选择采取适用航空器注册登记国法律;有共同经常居住地或共同国籍国法律的侵权当事人之间适用其共同经常居住地或共同国籍国法律;在事后选择的侵权当事人之间适用其事后选择的与侵权有真实联系的国家的法律;在上述几种法律选择方法无法判断或存在其他国家法律与该侵权有更为密切的联系时,适用与侵权有最密切联系地国家的法律。

The Application of Law in the Tort from Unruly Passengers in International Air Transportation

There are many characteristics of the tort from unruly passengers in international air transportation than the normal one, and these characteristics have direct influences in choice and use of the way to apply the law. Right now, uniform rule to apply the law is still needed to deal with the application of law in the tort from unruly passengers in international air transportation. The suggestions from this paper are: to apply the law of the state where aircraft registered. to apply the law of the state where is the common habitual residence of the parties or the parties have same nationality. to apply the law of the state that has real connection with the tort and has been chosen by the parties after the tort. to apply the law of the state that has a significant relationship with the tort when there is such a relationship or the above ways could not been used.
