| 摘 要： | 通过对现存离婚救济中损害赔偿、家务补偿、经济帮助等相关制度的分析,指出了建立我国离因补偿制度的迫切性和重要性。尤其对离因补偿制度的适用范围、补偿请求的事实依据、补偿数额的确定与支付以及补偿请求权的限制等制度构建中的具体问题,提出了新的见解和主张。

| Abstract: | After many years of judicial practice,China's marriage law on the protection of divorce relief system for the benefit of the weak side,reveals a lot of imperfections.Based on the analysis of damages divorce,domestic compensation,economic assistance and other related systems,it points out that it is very important and urgent to construct our country's compensation system for reason of divorce.Especially from the scope of application of the system,the factual basis for the request compensation,determine the amount of compensation and pay restrictions on the right to request compensation,and so on,new views and propositions are put forward. |
