论提单的有效转让与承运人无单放货的责任

从一起案例入手，结合英国、美国提单立法及UNCI-TRAL《货物运输法公约草案》有关规定，分析提单有效转让的条件，尤其是承运人无单放货后提单转让的效力问题。认为在承运人无单放货后，除非某人是根据承运人交货前的合同或其他交易安排善意取得提单，否则提单转让无效，承运人对其不承担无单放货责任。

Effective transference of B/L and carrier's liability for delivery of goods without B/L

From view of a case,on the basis of studying relative legislations of UK,U.S.and UNCITRAL Transport Law Draft convention on the carriage of goods wholly or partly]by sea],the conditions of transferring B/L,especially the effect of transference of B/L after the carrier had delivered goods without B/L were analyzed.It holds that unless a person becomes a holder of the B/L with good faith after the carrier has delivered the goods pursuant to contract or other arrangements made before such delivery,the transference of the B/L is null and void,the carrier shall not be liable for the claims against him of delivery of the goods without B/L.
