| 摘 要： | 在中国传统社会中,法律与道德相为表里,甚至融为一体。在今人看来纯属道德范畴的事情,恰恰正是传统法律重点制约规范的对象。加强对传统社会中道德法律化的研究,特别是对道德法律化在中国传统社会中的表现、历史演变及形成的原因进行研究,将有助于客观评价传统法律体系的历史作用及对现实的影响。

| Abstract: | In China's traditional society,law and morality were the two layers of one.Sometimes the two melted into one.But those that are in the scope of morality in the eyes of people today were the objects controlled by traditional law in the past.Enhancing the study of law-morality transformation,especially its representation,its development and its formative causes,will be of help in eval uating objectively the historic function of the traditional law system and its influence on social reality of the present society. |
