| 摘 要： | 解读法治要义与内涵,当以理性与正义为中心而展开.法治是理性催生的制度产物,法治为理性内核,以理性为根本,将理性得到最大化的体现.然而,法治不应仅仅停留于理性的层面.它以追求正义为终极目标,它将正义作为自身的内涵,无论是程序还是实质意义上的内涵,均体现了追求正义的踪迹.

| Abstract: | In order to understand the main idea and connotation of legal ruling, we should begin from rationality and justice. Legal ruling is a kind of system product of rationality and is the core and the foundation of rationality, which embodies rationality to the maximum. However, legal ruling shouldn't stay only on the surface of rationality but take justice as the final goal and connotation. No matter the procedure or the inherent connotation should embody the pursuit of justice |
