手术同意书的伦理和法律思考

手术同意书是医疗行业中,在手术之前必须签署的一份类似文本文件的文书。但手术同意书并不必然地等同于协议书,医院应该以人道抢救为优先,法律和生命权相冲突的时候,应首先保证生命权,而且我国法律已经赋予医疗机构和医务人员强制救护的权利。

Recently, there was a death case of a fetus and its mother resulting from its father＇s rejection on surgery consent. The crux of the problem is that this surgery consent. It is an Instrument like text files？？ which must be signed before surgery in Medical industry. The author believes that Surgery consent does not necessarily equated with agreement. Hospitals should give priority to the humane rescue, when law and life conflict, life should have the priority. And our laws have given the medical institutions and Medical staff the right of Mandatory rescue. The author suggests that a Independent professional arbitration should be set up.
