| 摘 要： | ＂放弃重复侵害行为＂在理论上和实践中争议颇多,有未遂说、中止说和折中说。其实,行为人在实施＂放弃重复侵害行为＂过程中,具有时间性、自动性和有效性,理应定性为犯罪中止,该定性符合我国以人为本的刑法理论,对推动我国司法改革,预防犯罪,保障人权具有重要意义。

| Abstract: | Abandoning repeated injurious act is controversial in terms of theory and practice. There are attempted theory, discontinued theory and eclectic theory. In fact, timeliness, automaticity and validity exists in the process when doer carries out abando- ning repeated injurious act, which should be characterized as crime termination. The characterization is in conformity with people first. It＇ s significant to promote judicatory reform, to prevent crime and to assure human fights. |
