| 摘 要： | 文章认为,我国民法上的无因管理应仅指适当的无因管理;《民法通则》109条规定的防止侵害行为可适用此制度,以求拓宽对管理人的救济途径;该文还对管理人的义务及其求偿权作了较为全面的阐述,最后为未来民法典中无因管理条文的制订提出了设计构想。

| Abstract: | The article tries to illustrate negotiorum gestio system in our civil law from such aspects as negotiorum gestio in our civil law should be proper negotiorum gestio and the act guarding against infringement in our civil law should apply to negotiorum gestio.Meanwhile,this paper makes an overall exposition on the manager's obligation and right of claim and put forward some conception as to the articles of negotiorum gestio for Civil Law Code to be drafted in the future as well. |
