法治政治与规则政治

法治政治是观察法与政治之间关系的新视角,是认识社会政治现象的"广义政治"的思维方式。根据法治政治的观念,法律是一种社会规则现象,政治是通过法律规则谋求社会公共秩序、分配社会利益的活动;崇尚法治政治是西方政治文明的基本特征,并因此而区别于东方权力政治的文化传统;法治政治本源于自然或人的规则理性;法治政治是以规则为本位的政治治理方式;法治政治的最高实现形式必然是宪法政治。

Rule of Law Politics and Rule Politics

Rule of law politics is a new perspective of exploring the relationship between law and politics, and it is also a new mode of thinking of understanding social political phenomenon. According to viewpoints of rule of law politics, law is a kind of social rule, and politics is a kind of activity which pursues social public orders and distributes social interests by law. Upholding rule of law politics is the basis characteristics of western political civilization, which, therefore, is different from cultural tradition of eastern power politics. Rule of law politics originates from natural or human rationality of rule. It is a way of political governance taking rule as the dominant factor and humanistic politics taking human as the dominant factor. Furthermore, its highest form of realization is certainly constitutional politics.
