论民族自决权与国家主权

冷战后的今天,民族自决权成为民族分离主义的理论依据,并对国家主权原则提出了严峻的挑战。国家主权与民族自决权是现代民族国家形成与发展的两大基本原则,两者相伴而生,是相互依存与相互制约的关系。现实生活中的冲突与矛盾并不意味着两者简单的对抗。在绝大多数国家获得了主权和独立的背景下,民族自决权的内容发生了很大的变化,其行使也要受到限制。

The National Sovereignty and The Right to Self-determination

The national autonomy is the theory base about the national separatism after the cold war, and had threatened the National Sovereignty. The National Sovereignty and the right to self-determination are two basic principles of the national-state forming and developing. The two were forming at the same time, and restricted each other. The conflict in the praxis didn't mean confront simply. The right to self-determination has become very much in the background of that many countries have had the sovereignty and independency, and its exertion must be restricted.
