以《李超传》为中心看民国女性家庭财产继承权

在"五四"运动的高潮时期,曾发生过一起引起社会广泛关注的事件——北京女子高等师范学校女学生李超之死,这一事件所关涉到的核心法律权利即女性家庭财产继承权,而这是女性经济权利的重要组成部分。胡适专门为此所写的《李超传》也成为中国现代对女性财产权进行观照的最重要文本,"可以用做研究中国女子问题的起点"。即使到今天,虽然国家赋予了女性和男性平等的法律地位,但是在中国广大乡土社会里,习俗的力量仍然强大无比,很多女性仍然没有实际享有家庭财产继承权等多项权利。因而我们今天再次审视和研究《李超传》,并以此来观照当今女性生存状态,仍然很有必要而且充满意义。

STUDY ON THE FAMILY PROPERTY INHERITANCE OF WOMEN IN THE REPUBLIC OF CHINA FOCUSING ON THE BIOGRAPHY OF LI CHAO

In the climax of the ＂May Fourth Movement＂,the death of the female student named Li Chao in Beijing Women＇s Normal School aroused wide concern.The core legal rights this event involved are the family property inheritance of women,which is an important part of women economic rights.Hu Shi specifically wrote The Biography of Li Chao which has become the most important text in the contemplation of women property rights in Modern China.It also can be seen as the starting point for the study of Chinese women.In this paper,The Biography of Li Chao will be taken as the core and the starting point to explore the evolution of women＇s family property rights and family status during the period of the Republic of China.Even today,although the state has granted equal legal status of women and men,but in China＇s vast rural society,the power of the custom remains strong,many women still did not actually enjoy family property inheritance rights and other rights.Thus we re-examine and study The Biography of Li Chao and to contemplate present women＇s living state is still very necessary and meaningful.
