暴力恐怖事件的行政救助机制研究

政府对暴力恐怖事件中的受害人及其近亲属施以行政救助在实践中已经存在,但在现实中却缺少法制的考量:一来无明确的法律规范,欠缺法定的义务来源;二来无相应的具体制度和应急机制,无法保证救助行为的有效落实。面对现实与理想、实然与应然之间的巨大反差,行政法学界有必要对我国暴力恐怖事件中的行政救助进行适当的质疑与反思:质疑其是否有存在之必要,反思其是否有改进之方法。如此,方能使法治理论契合现代社会发展之迫切需要,以突显法学作为一门社会科学的价值意义和实践精神。

On Administrative Assistant Mechanism of Violent Terrorist Incidents

That governments impose administrative assistance to the victims and their relatives in violence and terrorist incidents has been implemented,but in reality,the practice is difficult： one reason is the shortage of a definite laws; besides,there is no corresponding systems and response mechanisms to guarantee the effective implementation of the rescue behaviors. Facing the huge contrast between reality and the ideal situations,it is imperative for the administrative law scholars question and reflect the administrative assistance in violent terrorist incidents： Does its existence necessary？ Is there any improvement？ So,it is possible for the law theories to fit the urgent need of the modern society development,and at last,the law,as a social science,its value and practical spirit is highlighted
