工程项目合同双方风险分担问题的探讨

首先研究了国际学术界所确定的工程合同风险在合同双方之间划分的基本原则,并依照国际咨询工程师联合会(FIDIC)1999年第1版《施工合同条件》给出了常见的工程风险分类以及国际标准合同条件范本中的风险划分。认为成功的风险管理不单单取决于理论上的合理划分原则,还依赖合同的具体特点与合同双方对承担风险的态度。基于理论分析,给出了一个工程合同风险分担的简单模型。最后提出成功的风险管理所需的前提条件。

Allocation and Sharing of Construction Risks Between Contract Parties

This paper first introduces the basic principles advocated by the academia in the international construction industry regarding the risk allocation between construction contract parties. Then it presents the categorization of construction risks and their allocation in international construction contract, with particular reference to FIDIC Conditions of Contract for Construction(1st edition, 1999). Thereafter, it proposes that successful risk management relies not only on good allocation principles but also on the attitudes held by contract parties, with an analysis of the causes for such attitudes. Based on the theoretical analysis, a theoretical model is presented. Finally, preconditions for good risk management are put forward.
