巫术与中国传统法律文化

由于中国古代人文精神的发达,巫术往往被贴上野蛮落后的标签,同时巫术作为一种文化现象,其存在必然有着自身的一套逻辑和内在结构。中国传统法律文化以宗法伦理为核心特征,在巫术研究中能够发现某种程度上巫术文化也存在着此类特征,从巫术灵物与刑罚用具、巫术咒语与家族伦理和巫术犯罪与善恶观念三个方面尤其能够看到两种文化之间、中国传统文化之中的共通性。

Witchcraft and Traditional Legal Culture in China

Because of the development of Chinese ancient humanities, witchcraft is often labeled as barbarous and backward. At the same time witchcraft as a cultural phenomenon, its existence must have its own set of logic and internal structure. China traditional legal culture renders ethics as its core features, in witchcraft research field in some extent there also exist such characteristics, from three aspects of the Fetish and penalty appliance, spells and family ethics, the sorcery crime and the concept of good and evil, the intereommunity between two cultures in Chinese traditional culture is clear.
