城市流动商贩的商法规制探讨

对城市流动商贩要建立分类规制制度。偶尔从事经营活动的流动商贩应作为一般的民事主体，享有承担交易中的相关民事权利义务；持续从事营业性经营活动的流动商贩要纳入商法规制，可以享有营业权、商业秘密权等商事权利。但基于城市流动商贩的小规模经营，应豁免其进行商事登记、设立商事账簿。如果流动商贩自愿进行登记，其可以在一般商事权利之外享有经过登记才能享有的特有权利如商号权、商誉权。
