| 摘 要： | 保安处分制度的产生可以追溯到古罗马时代,但是受到特别重视却是到了近代的事情,保安处分之所以在近代兴盛与资产阶级的统治需要是分不开的.保安处分在古罗马的产生,经中世纪的缓慢发展,再到近代的兴起,而在现代各个资本主义国家的刑法典有所体现.通过实证法学角度来分析保安处分的历史沿革,对保安处分制度做出分析,并联系我国现实情况,以期将来对我国保安处分制度的设置有所借鉴.

| Abstract: | Measure of safety results from ancient Roman times and has been specially emphasized in recent times.The popularization of measure of safety is related to the demand of capitalism control. Measure of safety was produced in ancient Roman times and slowly developed in Middle Ages and is popular in modern times and is embodied in modern criminal law code in capitalism countries.This pa- per analyzes the historic evolution of measure of safety from the angle of science of positive law and analyzes the system of measure of safety on the basis of the reality of China in order to guide China's application of measure of safety. |
