我国学校法律地位的行政法探讨

摘    要:和谐校园建设是构建社会主义和谐社会的重要组成部分。如何界定学校的法律地位,成为解决学校与学生诉讼纠纷的关键点。我国现行法律对学校法律地位的界定模糊。结合国内外学者对该问题的主要观点,应明确我国公立学校的行政主体地位。

Abstract:The construct of harmonious campuses is an important part in the construction of harmonious socialism and harmonious society.The definition of the legal status of the school has become a focal point in solving legal dispute between the school and the student.In China's existing law,the definition of the legal status of the school is vague.China's public school's status of administrative principal part should be clearly defined by combining the major viewpoints of scholars home and abroad on this issue.
