| 摘 要： | 储蓄机构和储户究竟应由哪一方承担存款冒领纠纷案件中身份证件真伪不明时的证明责任,理论上存有争议,实务中亦存在分歧,这无疑会对司法实践的顺利、合理开展产生实质性的负面影响。基于对证明责任在此类案件纠纷各方之间的具体分配规则之考量,应该由储户来承担此时败诉的不利后果。

| Abstract: | Banks and depositors,as the two parties in the case of false claim on depositors,who should bear the legal liability of burden of proof about authenticity of identity cards? There is a controversy in both theory and practice and it will no doubt have a negative effect on healthy development of judicial practice.In this paper,the author uses the theory of distribution of legal liability of burden of proof to clarify the legal liabilities of each party in this case,and hopes to offer beneficial reference in theory for the specific operation in practice. |
