作为市场经济中用以约束市场主体行为的规范和准则,市场规则是一个有机的整体,其主要内容或构成要素包括产权规则、合同规则、竞争规则、企业规则和劳资规则等,这些要素相互作用、相互影响,共同支撑起市场规则的整个体系。文章对新制度经济学中产权理论、合同理论与市场规则体系的关系进行了研究,认为新制度经济学尽管研究的主要是产权和合同方面的问题,但这并不妨碍市场规则是一个由多方面内容构成的体系。

Research on the Market Rules and Its Forming Factors

This article inquires into the problems of the market rules and the factors which constitute the market rules, using the method of neo-institutional economics. As the standards and norms which restrain the behavior of the main body of the market in the market economy, the market rules are an organic whole. Its forming factors include property right rule, contract rule, competition rule, enterprise rule and labour-capital rule, etc. These factors interact, influence one another and constitute the market rules system mutually. This article also researches into the relationship between property right rule, contract rule and the market rules system in the neo-institutional economics. It points out that the neo-institutional economics mainly researches into the problems about property right and contract, but it does not hinder the market rules system from being constituted by aaried contents.
