| 摘 要： | 《物权法》对物下的定义过于简单,与我国社会生活实践严重脱节,在未来《民法典》中有必要对物的概念重新定义。目前,我国已有的几个物权法的专家建议稿与《物权法》相比,在立法技术和涵盖范围方面均有不同,有些方面值得未来立法借鉴。物的概念关系整个财产法的立法基础,需要单设条文详细规定。条文的设置,宜采用一般性规定+特别规定的模式,对物下个较为全面的名至实归的定义。
