| 摘 要： | 儒家法律文化经过了上千年的历史演化和社会积淀,以非传统的表现形式寄寓于我国现代社会之中,成为马克思主义法律思想实践于中国法治社会的承接力量,也是现代民间法形成的重要渊源。儒家法律文化中蕴含的人文主义精神,为马克思主义法律思想的本土化开辟了人文法治的道路,因此深刻挖掘儒家法律文化的现代价值具有重要的时代意义。
