| 摘 要： | 理论界对吸收犯的各种观点尚未能准确揭示出吸收犯的概念、类型及其与相关概念的区别。通过对吸收犯吸收关系生成机理的分析可以重新界定吸收犯概念,在此概念下,吸收犯类型实际上只有基本犯罪构成行为与修正犯罪构成行为或修正犯罪构成行为与修正犯罪构成的行为之间的吸收,吸收犯与相关罪数形态的区别也自然容易区分

By analyzing the generation principle of the absorption of the absorbed-criminal, we could find a new concept and type of the absorbed-criminal. |
