对农村房屋及宅基地管理与利用的调查和思考

我国法律规定农村村民“一户一宅”，房屋及宅基地是农民最基本的生活保障。农村房屋与宅基地有关的权利与农民的利益息息相关，与农村社会的可持续发展和构建和谐社会有密切关系，对其管理与利用更受到广泛的关注。2009年1月至2月，中国海洋大学“中国农村房屋及宅基地研究项目组”就相关问题进行了实证调查，试图发现其中存在的问题，并提出相关对策建议。

Investigations and Reflections on the Administration and Utilization of Rural Houses and Housing Land

Under the state legislation, every Chinese rural resident is regulated by ＂one household, one house site＂ policy. Houses and housing land are the rural residents＂ ultimate means of sustenance, and the rights related to them are critical not only to farmers＂ benefit, but also to the sustainable development of rural areas and the construction of the harmonious society. Therefore, the administration and utilization of rural housing rights has aroused extensive concern. From January to February in 2009, an empirical inves- tigation was made by a research and project team on the house and housing land in rural areas of China in Ocean University of China. Based on investigation and survey, the team seeks to find out the relevant problems and then put forward some suggestions and countermeasures.
