论基因权

随着基因技术的飞速发展，基因权将成为人类21世纪的一项新型权利，这项权利包括两大方面的内容，即关于基因资源权和基因技术知识产权。关于基因资源权的保护，应该针对我国的国情，通过修改宪法有关资源所有权的条款、确立新的资源所有权机制、制定专门的基因资源保护法等来实现。关于基因技术知识产权的保护，应采取综合保护战略，实现全方面的保护，特别是对农民群体的有关权利的保护。此外还有基因隐私权的保护，基因产品消费、使用过程中的安全权的保护问题。
