知识产品是一种知识财产,对知识财产进行产权界定的必要的。技术成果的产权制度有三类情形,以产权私有为主,兼以公有的双轨制为较优。产权交易与利用的制度主要有授权使用、许可使用和合理使用,它们各有利弊,应在公正性的基础上注重效益性。在产权保护和法律救济方面,应注意调节产权交易及保护的成本与收益的关系,促使理性的经济人放弃侵权行为。

Analysis of the basic systems of intellectual property rights from the perspective of law and economics

The intellectual property rights (IPR) product is one kind of knowledge property.This paper elaborates the IPR system choices by making clear the necessity of identifying the property right of IPR.On that basis, it goes on to re- spectively evaluate each utilization system of IPR by the measurement of both transaction cost and transaction benefit.In the end, the paper explains the legal remedy for IPR from the perspective of property right protection, i.e.the prevention from the infringement of IPR.
