| 摘 要： | 从我国宪法文本观察，基本权利的发生、成长和实现体现出独具特色的逻辑。宪法文义所体现出的人权的历史性和阶级性与宪法所确立的国家意识形态理论具有一致性。公民基本权利体系缺乏一种内在的一以贯之的逻辑自恰性，基本权利的国家保护义务相关条款与宪法适用的逻辑存在落差。如何弥补我国宪法文本中的人权逻辑缺失将成为宪法适用的重大课题。

| Abstract: | In observation of the text of our country's constitution,we find that there exist particular logic during the process in which basic rights occur,grow and become realized.The historic and class traits embodied in the constitution are in accordance with ideological theories of the country.As there is not an inner and constant logic self in the citizen basic right system,clauses related with state protection liabilities are not in accordance with the logic applicable to the constitution.How to make up the human right logic absence in the text of our country's constitution will be an important subject in our research of constitution application. |
