我国公立高等学校行政权力解析及规范策略——从权利与权力的关系视角

我国公立高等学校是通过法律法规授权而具有行政主体资格的事业组织,依法享有一定的行政权利,并行使相应的行政权力。而权利与权力的对立关系中权力对权利的异化和背离,导致高等学校的"实然"行政权力和"应然"行政权力不相匹配,甚至"应然"行政权力被"忽视"或"超越",导致权力的泛化和异化。可以采取制定《学校法》,保障高校行政权力规范运行;完善《高等教育法》,优化高校行政权力规范依据;贯彻行政法治原则,强化高校依法行政意识和能力;加强权力监管,构建高校行政权力制约监督机制等策略来加以规范。

Analysis of Administrative Power and Regulatory Strategy in Public Universities---From the perspective of relationship between the rights and powers

Public universities are qualified administrative body by the laws and regulations,and le-gally entitled to certain administrative rights （right）and to exercise appropriate administrative author-ity （power）.The alienation and deviation of right and power lead to the outcomes：the real execu-tive power and the ought executive power does not match in higher education institutions.The ought executive power is eitherignoredorbeyond,resulting in the generalization and alienation of power.The study thereby puts forward the development of theSchool Law to ensure university administrative power operate normatively;improves theHigher Education Actto optimize universi-ty administrative power in accordance with its norms;implements the general principles of adminis-trative law to strengthen the awareness and ability of university staff;and builds supervision and re-striction mechanism to standardize university executive power.
