国际私法适用与限制外国法的本位论

国际私法强调适用外国法的重要性和必要性，同时另一方面又制定一系列限制其适用的制度，这种“相互抵触”正体现了国际私法矛盾统一的重要特征。21世纪国际私法应在国家利益、当事人的合法利益和整个国际社会和谐的民商法律秩序的建立三者之间寻找到一个合理的结合点，使这三者之间的矛盾得到完美的统一。

On the Standard of Application and Restriction of International Private Law on Foreign Law

International Private Law emphasizes the significance and necessity of application of foreign law, at the same time it has formulated a series of systems restricting the application of foreign law. The mutual contradiction embodies the important characteristic of International Private Law which should seek a balance among country benefit, legal personal benefit and the establishment of harmonious order of entire international community and should make contradictions to get the consummate unification in 21 centuries.
