In modem society, Criminal Law has its functions concerning to two demensions which including stabling the political governance and ensuring the innocent avoid state＇ s suppression. Under the very idea, we must not read what criminal law functions in the sense of legal philosophy, but also in the sense of constitutionalism about how it works.
