| 摘 要： | 近代中国法律教育的现代化发展，在半殖民地半封建的畸形社会土壤上走过了一条曲折而亢奋的历程。在这一发展过程中，“制度主义”谬误的产生不是偶然的，有其历史必然性。它如同打开了潘多拉匣子一样，虽不自觉地引发了近代中国法律教育向现代化纵深发展的历史潮流，但也不可避免地使近代中国法律教育发展之路遭遇颇多坎坷，具有鲜明的时代特征。这种建立在文化误读基础上的“制度主义”谬误，在近代中国法律教育现代化变革中的影响是双重的。

| Abstract: | The modernization development of law education in Modem China is through a tortuous and stimulated process in the soil of a semi-colonial and semi-feudal lopsided society. ＂Insfitutionalism Falsehood＂ in its development is not an accident, but historical inevitability. It is like opening a Pandora＇ s box, not consciously triggered the historical trend of law education to the depth modernization, but inevitably to make the development of legal education bumpy with distinct time characteristics in modern China. The effect is twofold in the transform of law education in such a culture based on ＂Institutionalism Falsehood＂. |
