| 摘 要： | 和谐社会是人类孜孜以求的理想目标。为了更好地构建和谐社会，必须要适当地行使国家刑罚权，因为刑罚权既能保障权利，同时也很容易侵害人权。因此，刑罚权的运行必须遵循正当法律程序，使刑罚权具有谦抑性和人道性，这才是构建和谐社会的应有之道。

| Abstract: | A harmonious society is an ideal for which mankind has been searching indefatigably. For the sake of a better built harmonious society, it is imperative to exercise the state penal powers in a proper way, because they can, for one thing,safeguard rights,for another,violate human rights. Therefore,the enforcement of penal powers must conform to the just judicial procedure so as to equip the powers with modest restraints and humanity,which is the rational way to the building of a harmonious society. |
