不动产抵押物转让效力问题研究

摘    要:抵押期间抵押人可以不受限制地自由转让不动产抵押物,但在不动产抵押物转让效力问题上,采纳传统的单一物上追及说,未必是保护抵押权人利益的最佳途径,并且会不当地放纵原来的抵押人,也难以为抵押物受让人提供十分有效的救济手段;而采纳单一物上代位说,抵押权的效力又无法获得充分的保障。采纳物上追及与物上代位的选择竞合说,由抵押权人选择物上代位还是物上追及,是解决这一问题较为理想的途径。

Abstract:Within the period of mortgage,the real estate pledge can be transferred freely without any restriction,but there are many different viewpoints on the effect after the pledge has been sold out.The adoption of the single right to recourse isn’t the best way to protect the interests of mortgagee and cannot provide an effective relief method for the buyer.On the other hand,the single right of claim over subrogation may cause the possibility to destroy the legal effect of real estate mortgage.So we should adopt the selective concurrence of recourse right and subrogating right in real estate mortgage,thus the mortgagee has the right to choose between them.
