论国际诉讼中的法庭之友

随着国际司法机构改革与实践的发展,法庭之友在国际诉讼中获得了较大的发展。现今法庭之友的问题不再是其能否参与国际诉讼,而是如何更好地适用。在实践中,时有法庭之友向法庭递交意见书的情形,而各国际司法机构对法庭之友的接受程度有所不同。缺乏对法庭之友参与国际诉讼的具体规定,不利于法庭之友的发展。对法庭之友参与国际诉讼的必要性和可能性进行阐述,对其参与国际诉讼的实践以及存在的问题进行简要分析,以期对今后法庭之友的发展有所裨益。

On amicus curiae in international litigation

Along with the development of reform and practices of international judicial institutions, the amicus curiae acquires great development in international litigation. The issue on amicus curiae is no longer whether or not it can participate in international litigation, but how to apply it better. In practice, the amicus curiae always submits position paper to the court, while different international judicial institutions have different acceptance attitude to the amicus curiae. It is not conducive to the development of amicus curiae that there are not enough specific regulations on participation in international litigation of the amicus curiae. The possibility and necessity of the amicus curiae participating in international litigation are demostrated, the practices and problems of it are analyzed briefly, in order to benefit the development of amicus curiae in the future.
