论无效信托

一般情况下 ,设立一项有效的信托是信托各方当事人的初衷 ,但实践中往往由于主观或客观的原因 ,信托当事人所设立的信托存在着各种瑕疵 ,而各种不同的瑕疵对信托效力的影响很大 ,在许多情况下将会导致信托无效。英美信托法制与大陆信托法制呈现了较大的相似性、趋同性和一定的差异性 ,这些都是进一步完善我国信托法制的有效借鉴。

ON INVALID TRUSTS

Generally speaking the parties concerned in trust expect to make a valid trust,but in practice the trust set by the parties concerned has many defects because of subjective or objective reasons and these defects influence the effect of the law of trust so greatly as to lead to an invalid trust.There are similarities, tendencies for assimilation and certain differences between continental genealogy of trust law and Anglo-American genealogy of trust law .All these experiences may serve as effective references for the further improvement of Chinese trust laws.
