| 摘 要： | 一般观点认为,农民土地上访是"地权"不明晰造成的,解决的办法就是赋予农民"地权"。本文在对东县四年农民土地上访详细分析的基础上,归纳出农民土地上访的六种类型以及三种性质的"地权"纠纷。东县的事实表明,近年来出台的一系列"确权"性质土地政策法规逐步赋予农民"地权",削减村组集体在土地上的权力,不仅没有减少农民"地权"纠纷,反而激化了土地矛盾,导致大量的农民土地上访。本研究表明,一般的观点可能忽视了中国农村现实,若其形成政策影响时,可能会在政策设计上烙上较强的意识形态色彩。那么,沿着这个思路进行中国农村土地制度改革,会造成更多的农民上访,破坏农村稳定和谐的基础。
