| 摘 要： | 国家-社会关系的后全能主义特征决定了政府既鼓励行业协会独立发展，又赋予其广泛的行业公共治理功能。杭州市和温州市行业协会履行公共治理功能的意愿、能力、效果如何，往往与政会关系是否厘清有很大关联。政府向行业协会转移职能，需以对行业公共治理功能在政会间的合理界分为前提。借鉴外部经验，或可建立区域性商会，并赋予其公法人地位；或可落实行业协会社团法人的地位，建立和完善政府购买协会服务制度。
