| Abstract: | The author holds that the formation of responsibility for mental compensation in malpractice lawsuit includes four aspects: confirmation of malpractice, existence of facts of mental injury, cause-effect relation between the two, and the faults of medical workers. The author also presents speculations on the mechanism for mental compensation and deals with the natures and functions of mental compensation, applicative people and principles for the establishment of compensation fee. |
