| 摘 要： | 在罗马法的发展历程中,裁判官作出了巨大的贡献,而这种贡献最重要的表现就是裁判官法。从裁判官创立之日起到哈德良皇帝时代,裁判官法经历了创立、发达和衰落的发展阶段。与市民法相比,它有着重意图轻形式、比较灵活的特点,而这些无疑使罗马法达致发达,并成为它日后得以复兴并影响世界文明的重要因素。 |

| Abstract: | During the development of Roman law,the praetors made a great contribution to it.From the foundation of the praetor to Imperator Hadrianus times,ius praetorium also went through its establishment,prosperity and decline.Compared with ius civile,it paid great attention to real intention of the parties other than the formality,meanwhile it was more flexible,which undoubtedly played an important role in the flourishing of the Roman law,its revival and worldwide influence. |
