| 摘 要： | 中国正在进行民法典的起草工作,妥当地配置不同类型的民事法律规范,是我国能够制定一部优秀民法典的一项基本条件。通过对《合同法》中任意性规范、倡导性规范、授权第三人的法律规范、强行性规范以及混合性规范等配置的反思,为我国民法典的起草提供些许建议。

This article tries to give some suggestions for the drafting of Chinese civil code by analyzing the arrangement of different norms in contract law ,such as the arrangement of permission norms, mandatory norms,etc. |
