| 摘 要： | 国际私法对实质正义的追求必然产生在涉及弱者的领域中适用的法应是有利于弱者利益的。弱者的共性、系属公式的特点及国际国内社会的立法现状、司法实践决定了有必要将有利于弱者利益的法确定为系属公式。有利于弱者利益的法在适用中有不同的表现形式。

| Abstract: | The result of pursuing substantive justice in private international law is to apply the law favored to interests of the weak party in the realm related to the weak party. The common nature of the weak party, the character of formula of attribution, legislation and judicial practice of international and national society determine the necessity of stipulating law favored to interests of the weak party as formula of attribution. Law favored to interests of the weak party can be applied in different styles. |
