论环境行政指导及其法律规范

环境行政指导区别于传统的强制型环境行政行为,它是社会现实变革、行政理念发展以及环境保护要求等因素共同作用的结果。环境行政指导是一种非强制性、以利益诱导为主的事实性行为,具有弥补法律缺陷、预防环境污染与破坏、协调各方利益的功能。现实国情下,环境行政指导法律规范的目标为规范环境行政指导权、发挥环境行政指导的应有作用,方向为界定环境行政指导的范围、规范环境行政指导的决策、确立环境行政指导的程序、提供环境行政指导违法的救济。

On Environmental Administrative Guidance and its Legal Regulation

Different from traditional compulsory environmental administrative act,environmental administrative guidance is the interactive result of change of social reality,development of administrative concept,and requirements of environment protection.It is a non-compulsory and mainly interest-induced factual act with the function of making up for the legal defects,preventing environment pollution and damage,coordinating interests of all parties.Under current situation,the aim of regulating environmental administrative guidance is to regulate its power and to play its proper role;the orientation of environmental executive direction is to define its scope,to regulate its decision-making,to establish its procedure and to provide relief when it gets violated.
